Unpairing Your Bird

You can also Unpair your Bird with the Bird app. This option makes it easy to transfer ownership to someone else, either temporarily or if you sell your Bird.

To Unpair your BirdOne, open the App Menu in the top left of the app and select My Bird from the menu. In the My Bird screen tap the Unpair 1 button.

After you Unpair, your account will no longer be associated with the Bird. To connect it, you’ll need to pair it again.

Charging your BirdOne

Charge the vehicle using the power supply provided when you received the vehicle. Do not use any other power supply or damage to vehicle may result. Always keep your vehicle plugged in and charging overnight — never let the battery run to 0. Normal electricity rates apply.

Warning: NEVER attempt to charge a wet vehicle. Serious injury or death can incur
Pairing your BirdOne with your App

To pair your device to your BirdOne you will need to scan your Bird’s QR code.

  1. Ensure your Bird is fully charged.
  2. Ensure your phone is connected to Wi-Fi and Bluetooth is on; you will need both to connect to your Bird.
  3. Open the Bird app and select the Ride button at the bottom of the screen.
  4. Aim your phone’s camera at the QR code located on the right handlebar and wait for the scan to complete.

You will receive a message that says ‘Welcome to your One.’ That indicates that your device has successfully paired to your Bird.

Where you Can Ride

You can ride wherever personal, micromobility vehicles are allowed in your city. Always abide by existing local rules and regulations pertaining to riding micromobility vehicles.

Per Federal Aviation Administration (FAA) guidelines, you may NOT transport your Bird on an airplane.

Riding your BirdOne

To use the vehicle, you must use the Bird app associated with your account. Think of your Bird app as the key to your vehicle. You can use the app to see how far you can travel on any given charge and track your Bird. Plus, your vehicle will get even better over time with new features and functionality introduced via app updates.

To use the vehicle, simply scan the 4-5 digit QR code of your Bird or locate the "My Bird" option in the menu. From there you can view your Bird and the controls available to you.

At the bottom of the screen slide to unlock your Bird. Manually kick-push the vehicle like you would a non-electric scooter to get it moving, then press down on the throttle. From there the vehicle will be fully electric.

Repeat the kick-push process if at any point you come to a complete stop.

You can ride wherever personal, micro-mobility vehicles are allowed. Local and regional rules apply.

As the owner, it is at your discretion if you want to lock your vehicle or not. But we recommend that you lock your vehicle, just as you would a bicycle when it is parked outside.

After you ride

Once you’re done riding, you can park and lock your Bird. This will lock the wheels and turnoff the lights. If your Bird is left locked, it is still powered on and will deplete the battery, so we recommend charging it once you’ve completed your last trip.

After you ride, be sure to charge your Bird via the Charger Port to ensure it’s always ready to ride when you need it.

Keep in mind that powering on the Bird again will require a Bluetooth and Internet connection.

I can’t scan my QR code during setup.
  1. Tap the QR Code Input Button 1 and type in the digits below the QR Code. 2
  2. Tap the Flashlight Button 3 to turn on your flashlight if it’s too dark for your phone’s camera to scan.
If you receive a Trouble Connecting error after scanning:

Double check that your Bluetooth and Internet connection are enabled on your phone.

The app won’t unlock my Bird.

Examine your BirdOne to make sure there are no physical issues preventing it from unlocking. If not, try restarting the Bird app and verifying your Bluetooth and internet connection.

My Bird won’t start.

This could be because your BirdOne does not have a sufficient charge to ride. Plug it in and charge fully, then try again.

My Bird got wet and it doesn’t work anymore!

Don’t panic! Let the BirdOne dry for at least an hour before trying again. If it still doesn’t work, contact our support team.

Something broke on my Bird!

As a BirdOne owner, you have prioritized customer support. Contact the support team to begin the repair process.

Can I still ride my Bird where scooters aren’t permitted?

Yes, but we recommend riding in permitted locations whenever possible.

Since I own my BirdOne, can I customize it with stickers or paint?

Yes, but try not to cover important information or identifiers (QR code, serial number, vehicle instructions, Bird logos, headlight, brake light). Keep these features intact for your safety and if your Bird needs maintenance.

Account & Ownership

Can I still rent a shared vehicle?

Yes, you can still use the Bird app to rent shared dockless vehicles. Standard fees apply.

Pairing Multiple Accounts with my Bird

At this time, a BirdOne can only be paired with one device at a time - this allows for a secure connection between you and your vehicle.

  1. If you would like to connect the BirdOne with another account, simply locate the "My Bird" option in the menu of your application and scroll down.
  2. Near the bottom of the scroll, select "UNPAIR."
  3. Upon unpairing, scan the QR code of the BirdOne with the new device.
  4. The Bird will pair and the "My Bird" option will be available on the new device.

Keep in mind, once you’ve unpaired your BirdOne from your device it is available to anyone who scans it while unpaired.

Vehicle Theft & Impounds

Your Bird has built-in GPS location technology and advanced network connectivity allowing you to track your Bird. You can track your individual Bird within the My Bird section of your app. If you need assistance tracking your BirdOne, contact us via the help section of your app.

If your vehicle is impounded please work with local law enforcement to recover your vehicle.


Vehicle Modes & Controls

Sleep Mode
What is Sleep Mode?

Sleep Mode lets you completely power-down your Bird while helping to conserve its battery. Once Sleep Mode is activated, your Bird will no longer have a cellular connection, so you won’t be able to track its location or receive any alerts. Because of this, you should make sure that your Bird is secured indoors before leaving it in Sleep Mode.

We strongly advise to only use Sleep Mode when:

  • You’re planning on not using your Bird for a few days
  • You need to perform a hard reset on your vehicle
How to activate Sleep Mode.
  1. Open your Bird app
  2. From the menu tap My Bird
  3. Hold your phone close to the handlebars
  4. Select Sleep and tap Continue on the next screen
How to wake up your Bird.
  1. Open the Bird app
  2. Tap My Bird on the home screen
  3. Hold your phone close to the handlebars
  4. Select wake

After following the steps to wake up your Bird, you’ll see a progress bar that shows how long the process will take. Keep in mind that it may take up to five minutes to fully wake your Bird.

Note: Leaving your Bird in Sleep Mode for more than 40 days without charging may damage your vehicle. If you need to put it to sleep for more than 40 days, be sure to wake the Bird and charge it for 24 hours before putting it back to sleep.


Notifications & Alerts

Bird 'Already Taken' Notification

If you scan your BirdOne and receive the message, ‘This has already been taken.’ It means that another device is currently paired to that BirdOne. To pair it back to your account follow these steps:

  1. The other device will need to locate the "My Bird" option in the menu of your application and scroll down.
  2. Near the bottom of the scroll, select "UNPAIR."
  3. Upon unpairing, scan the QR code of the BirdOne with the new device.
  4. The Bird will pair and the "My Bird" option will be available on the new device

Your BirdOne Experience

It’s official: This Bird is yours. Thank you for choosing an electric ride to cruise past traffic and reduce carbon emissions. As part of the flock, every ride you take truly makes a difference. Now let’s get you up and flying.


Let’s ride

Once your BirdOne is fully charged, you can unplug it and start your first ride.

For your safety, always wear a helmet while riding. Also, be sure to inspect the Stomp Brake to make sure it's fully functional as well as the vehicle frame and neck for any cracks or wear before riding.

Starting and Stopping

Place one foot on the footboard and kick with the other to propel forward. Hold down the Accelerator (right thumb throttle) to go faster (up to 16 mph). Use the Stomp Brake on the back wheel to decelerate or stop the vehicle. Additionally, it is possible to use the left handlebar as a brake for the vehicle.

Where to Ride

We recommend riding in bike lanes or close to the curb in the street. It’s important to note there are locations that do not permit e-scooter riding or parking; please always follow local rules and laws. Avoid sharp bumps, drainage grates, and sudden surface changes.

After you Ride

Once you’re done riding, you can park and turn off your Bird by holding the power button for 2 seconds. This will turn off the dash display as well as the light. Also, once your Bird is turned off be sure to charge it via the Charger Port to ensure it’s always ready to ride when you need it.

Maintaining Your BirdOne
  • No zeros: Prevent delays by keeping your Bird charged.
  • Clear Skies: Avoid riding your Bird during and after wet or extreme weather conditions (rain, snow, etc.).
  • The art of Bird maintenance: Examine the following Bird parts before every ride to keep your Bird in great shape. As always, we’re here to help should an issue arise. Please email us at shop@birdcanada.co if you have any questions about your Bird maintenance.
    • Brakes: The Stomp Brake shouldn't be resting on the back wheel when in a resting position. Test it by stepping on it while rolling forward to verify that it stops the wheel when pressed and springs up when released. Also test out the brake on the handlebar at a low speed to make sure it slows the Bird properly.
    • Tires: Make sure the tires are in good condition and still have sufficient tread
    • Steering: Move the handlebars back and forth to check that the steering is tight. Also rotate the handlebars to the left and right to make sure the steering is smooth and doesn't bind or stick in any way.
    • Neck: Make sure the neck sleeve has no visible cracks and the lever clicks in place upon unfolding.
  • Gimme shelter: If you leave your Bird outside, keep it dry by placing it under a cover. Take your Bird inside in case of extreme weather conditions and temperatures.
  • Keep it clean: If your Bird gets dirty from rough terrain or heavy use, just give it a quick wipedown.
    • Use a soft, wet cloth for basic cleaning.
    • Use a toothbrush for scrubbing.
    • Do not use corrosive cleaning chemicals that may damage your Bird. These include:
      • Gasoline
      • Acetone
      • Alcohol

Troubleshooting
Can I still ride my Bird where other shared Birds aren’t permitted?

Yes, but we recommend riding in permitted locations whenever possible.

Something broke on my Bird!

My Bird got wet and it doesn’t work anymore.

Don’t panic! Let the Bird dry for at least an hour before trying again. If it still doesn’t work, contact our support team.

My Bird is plugged in, but won't charge.

If your battery isn't charging up right away (LED on power supply is still showing green and not red), it may be due to a safety feature that allows the battery to cool before starting to charge. As it cools off, you can leave it plugged in - just give it 30-60 minutes to cool off and then check again.

In cases where the troubleshooting solutions do not fix the issue, contact the support team at shop@birdcanada.co.

To Avoid Serious Injury:

The manufacturer recommends riders be 16+ years old. Read and understand all safety warnings listed on the product label, located on the left side of the scooter deck. Always follow these safety instructions.

  • People who should NOT ride the BirdAir include:
    • Anyone under the influence of alcohol or drugs.
    • Those with heart conditions, pregnant women, or persons with head, back, or neck ailments that limit their ability to ride safely.
    • Persons with any mental or physical conditions that may make them susceptible to injury or impair their physical dexterity or mental capabilities to recognize, understand, and perform all of the safety instructions and to be able to assume the hazards inherent with the BirdOne.
  • Comply with local laws and regulations when riding this product. Do not ride where prohibited by local law.
  • Do not ride in the snow, in the rain, or on roads which are wet, muddy, icy, or that are slippery for any reason. Do not ride over obstacles. Doing so could result in loss of balance or traction and could cause a fall. Whenever you ride your vehicle you risk injury or death from loss of control, collisions, and falls. Be sure to read the User Manual.
  • When braking rapidly you risk serious injury due to loss of traction and falls. Watch your speed when traveling downhill. For best results in stopping and deceleration, always use the stomp brake in conjunction with the left handlebar brake. Left handlebar brake should not be used alone to stop at high speeds or when traveling downhill.
  • Ride safely to avoid falls or collisions.
  • Do not use the BirdOne for racing, stunt riding, or other maneuvers, which may cause loss of control, or may cause uncontrolled operator actions.
  • Avoid contact with moving parts. Ensure hands, feet, hair, clothing, and other body parts stay clear of moving parts like the motor or rear wheel.
  • ALWAYS keep both hands on the handlebar when riding.
  • DO NOT exceed the maximum weight: 220.0 lb (99.8 kg).
  • DO NOT ride the scooter in the rain or on wet ground.
  • DO NOT ride over speed bumps, thresholds, or other bumps at high speed.
  • DO NOT press the throttle when walking with the scooter.
  • DO NOT ride on sidewalks, motorways, or highways.
  • DO NOT rotate the handlebars suddenly while driving at high speeds.
  • DO NOT ride with more than one rider.
  • DO NOT ride up and down stairs.
  • DO NOT jump over obstacles.

Electrical Warning:

DO NOT attempt to disassemble the battery. This is a fire risk.

  • Never modify the electrical system as this may result in a risk of electric shock, electrocution, or fire.
  • To prevent electric shock, do not immerse the charger or battery in water when cleaning. To clean, remove the charger plug from the outlet and wipe with a dry cloth.
  • Only use the charger specified by the manufacturer.
  • Only store is dry areas. Never store in wet conditions.

Congratulations on your BirdOne! For the best, safest and most enjoyable ride, we recommend inspecting your vehicle before each use. If your vehicle fails to pass anything on the Pre-Flight Checklist, please contact Bird Customer Support before taking your next ride. Our Pre-Flight Checklist should be conducted when the vehicle is not in motion.

Smooth Steering
  • While the vehicle is not in motion, slowly turn the handlebars all the way to the right and left. The steering action should be smooth. If the steering is not smooth, do not ride the vehicle prior to contacting Bird Support.
Neck Check
  • Place one foot on the floorboard , push the handlebars forward and backward. If there is excessive movement, do not ride the vehicle.
  • Examine the joint at the bottom of the neck where the shaft and base meet. If there are visible cracks or looseness, do not ride the vehicle prior to contacting Bird Support.
Throttle with Ease
  • Fully press down the throttle 5 times. The action should be reasonably smooth with no sticking. If the throttle does not return to neutral, contact Bird Support before riding.
Pump the Brake
  • Pull the brake lever as far as you can 5 times. The lever action should be smooth and have some tension. If this is not the case, contact Bird support before riding again.
  • When the brake lever is pulled, check that the rear brake light is on with a rapid blinking. If the rear brake light does not turn on when the lever is pulled, contact Bird Support before riding again.
Screw Tightness
  • Examine all visible screws. tighten loose screws by rotating them clockwise until snug. Do not ride until all screws are tight.
Headlight Heads Up
  • Check that the headlight stays on and does not flicker in both daylight and evening hours.
Wheel Inspection
  • Firmly grab each wheel and check for side to side movement by pushing left and right. If you experience side to side movement, do not ride the vehicle.

Assembling the One

Your BirdOne is partially assembled already, so you’ll only have to do a few things to get riding. First, locate the screw, wrench, and power supply.

A full list of BirdOne’s specifications> can be found below.

Step 1: Unboxing

Detach the three tabs located at the top of the packaging box. Open the box and pull the vehicle up from the neck. Peel off the tape holding the two foam casings together and set the vehicle on its side to separate the casings.

Step 2: Assembly

Set aside the wrench and screw included in the hardware bag. Move the kickstand out before removing the vehicle from the remaining foam casing. With one hand on the neck and one hand on the deck, slide the vehicle out and place it on the ground. It should stand on its own with the kickstand out.

Lift the neck over the aluminum tube, aligning the it with the bottom of the vertical tube. Click the neck assembly into place by pushing down on it. Take the included screw and push it through the center hole in the clamp. Install it with the included wrench to fasten the clamp.

Using the same wrench, tighten the left clamp screw positioned near the deck. Then, tighten the two clamp screws on the opposite side. Once installed, tighten all four clamp screws again.

Step 3: Charging

Once you’ve assembled your Bird, it’s time to charge. Use the included power adapter and connect it to the charging port. Do not charge your Bird if either your Bird’s charging port or power supply are wet. If either are wet, wait for them to dry and then begin charging.

Once assembled and charged, your BirdOne will be ready to pair to the Bird app.

Warning: Do not attempt to charge if the charging port or power adaptor is wet.

Warning: Only use charger specified by the manufacturer

Warning: Ambient temperature must be 32-104° (0-40°C)" during charging. The battery will not charge outside of these temperature limits.

Battery Pack Maintenance
  • Do not store or charge the battery at temperatures outside of the stated limits (see specifications below). Do not puncture the battery. Refer to your local laws and regulations regarding battery recycling and/or disposal.
  • A well maintained battery can perform well even after many miles of riding. Charge the battery after each ride to avoid draining the battery completely. When used at room temperature (70°F [22°C]) the battery range and performance is best.
  • Warning: Do not attempt to disassemble the battery. Risk of fire. No user serviceable parts.
  • Warning: Do not ride when the ambient temperature is outside of the operation temperature (see specifications), because low/high temperature will limit the maximum power/torque. Doing so could cause personal injury or property damage due to slips or falls.

Download the Bird app.

Think of the app as the key to your Bird. It’s similar to riding a Bird in the wild, except you have an added feature: the My Bird page. Once downloaded, open the app and create your Bird account.

Pair your BirdOne.

Open the app and select QR Reader at the bottom of the map to scan your Bird’s QR code. Make sure your phone has Wi-Fi and Bluetooth turned on.

Aim your phone’s camera at the QR code located on the right handlebar and wait for the scan to complete.

Using My Bird

After your Bird has been paired, open the App Menu in the top left of the screen and select My Bird from the menu. My Bird helps you access and manage the features of your Bird.

These features include:

  • Riding
  • Charging information
  • Identification
  • Anti-Theft
  • Current location (with GPS map)
  • ...and other features!

Let’s ride

Once your BirdOne is fully charged, you can unplug it and start your first ride with the app. From My Bird, slide the left arrow to the right of the screen in the Slide to ride section. Then, scan your Bird’s QR code to unlock the wheels. Your Bird will chirp if you move it while locked.

Remember, Bluetooth and Wi-Fi must be enabled to lock and unlock your Bird.

For your safety, always wear a helmet while riding. Inspect vehicle frame and neck for any cracks or wear before riding.

To Avoid Serious Injury:

The manufacturer recommends riders be 16+ years old. Read and understand all safety warnings listed on the product label, located on the left side of the scooter deck. Always follow these safety instructions.

  1. People who should NOT ride the BirdOne include:
    • Anyone under the influence of alcohol or drugs.
    • Those with heart conditions, pregnant women, or persons with head, back, or neck ailments that limit their ability to ride safely.
    • Persons with any mental or physical conditions that may make them susceptible to injury or impair their physical dexterity or mental capabilities to recognize, understand, and perform all of the safety instructions and to be able to assume the hazards inherent with the BirdOne.
  2. Comply with local laws and regulations when riding this product. Do not ride where prohibited by local law.
  3. Do not ride in the snow, in the rain, or on roads which are wet, muddy, icy, or that are slippery for any reason. Do not ride over obstacles. Doing so could result in loss of balance or traction and could cause a fall. Whenever you ride your vehicle you risk injury or death from loss of control, collisions, and falls. Be sure to read the User Manual.
    • When braking rapidly you risk serious injury due to loss of traction and falls. Watch your speed when traveling downhill. Apply brakes when traveling at high speeds. If brakes are loose, tighten with the brake tensioner nut located at the rear of the scooter. Turn the nut clockwise to tighten and increase braking strength.
    • Ride safely to avoid falls or collisions.
    • Do not use the BirdOne for racing, stunt riding, or other maneuvers, which may cause loss of control, or may cause uncontrolled operator actions.
    • Avoid contact with moving parts. Ensure hands, feet, hair, clothing, and other body parts stay clear of moving parts like the motor or rear wheel.
    • ALWAYS keep both hands on the handlebar when riding.
    • DO NOT exceed the maximum weight: 220.0 lb (99.8 kg).
    • DO NOT ride the scooter in the rain or on wet ground.
    • DO NOT ride over speed bumps, thresholds, or other bumps at high speed.
    • DO NOT press the throttle when walking with the scooter.
    • DO NOT ride on sidewalks, motorways, or highways.
    • DO NOT rotate the handlebars suddenly while driving at high speeds.
    • DO NOT ride with more than one rider.
    • O NOT ride up and down stairs.
    • DO NOT jump over obstacles.

Electrical Warning:

DO NOT attempt to disassemble the battery. This is a fire risk.

  • Never modify the electrical system as this may result in a risk of electric shock, electrocution, or fire.
  • To prevent electric shock, do not immerse the charger or battery in water when cleaning. To clean, remove the charger plug from the outlet and wipe with a dry cloth.
  • Only use the charger specified by the manufacturer.
  • Only store is dry areas. Never store in wet conditions.

Manufacturer’s Limited Warranty

This is the manufacturer’s limited warranty (“Limited Warranty”) for the BirdOne (“Product”) for consumers in North and South America. This Limited Warranty describes the service available to you in the event your Product requires warranty service, and you may have additional protections under your local laws.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM COUNTRY TO COUNTRY AND STATE TO STATE.

This sheet and the original purchase receipt for the purchase of your Product are the documents defining the Limited Warranty. Please retain this document and the original purchase receipt to preserve your warranty service.

RECORD YOUR PRODUCT’S SERIAL NUMBER

Record your Product’s Serial Number below. You can find the Serial Number on the exterior of the shipping box, on the bottom of the Product, or in the Bird App, while connected to the Product.


1. Limited Warranty Period

This Limited Warranty covers all defects in material and workmanship of the Product arising or occurring as a result of your normal and ordinary use of the Product. In the event a defect covered by this Limited Warranty occurs, Bird will repair or replace your Product in accordance with the terms of this Limited Warranty. The applicable period for the Limited Warranty begins from the earlier of either: (i) 30 days following the original purchase date of the Product from Bird or an authorized Bird distributor or dealer; or (ii) the activation date of the Product through the Bird App, and applies to the Product in the following ways:

REPLACEMENTS AND REPAIRS

The longer of: (i) the remainder of the original Limited Warranty for the Product; or (ii) 90 days from the consumer’s date of receipt of the replacement or repaired Product.


2. Limited Warranty Service Process

Bird’s online help resources are available at: http://www.bird.co/one-guide. If you discover what you believe is a defect for your Product, please contact Bird at 1-866-205-2442 or at hello@bird.co. Bird’s technical support personnel are available to assist you in diagnosing and fixing any problems you may encounter in the use of your Product. In the event we cannot help you fix the problem, you may be entitled to warranty service under this Limited Warranty.

In order to submit your Product for warranty service pursuant to this Limited Warranty, you will be asked to provide Bird with (i) the proof of purchase from Bird or an authorized retailer; and (ii) the Product’s serial number. Upon verification of your eligibility, you will need to provide your name, email address, mailing address and contact telephone number

in order to receive a return materials authorization (“RMA”) number. Bird must receive your defective Product within thirty (30) days from Bird’s issuance of an RMA to you. Bird may direct you to a designated third party for warranty repairs.

You must include your defective Product within the Bird-provided or Bird-approved packaging for shipment to Bird. You are responsible for any damages caused by your improper packaging or shipment of the Product to Bird, or risk of loss during transit.

An authorized service provider will conduct an inspection of your Product. If Bird determines that the problem is not covered under the Limited Warranty, Bird will notify you and inform you of service or replacement alternatives that are available to you on a fee basis, or Bird will return your Product to you unrepaired.

For eligible warranty claims, Bird will service defective Products with new or reconditioned parts of same or similar style at no cost to you for the service. Parts replaced by Bird will be retained by, and become the property of Bird. For eligible warranty claims, Bird will pay reasonable return shipping charges for the return of the Product to you.


3. Limited Warranty Eligibility

3.1 Your request for service must be received by Bird within the Limited Warranty Period as described above, and Bird must receive your Product in accordance with the Limited Warranty Service Process defined above.

3.2 Your Product must be purchased from Bird or an authorized reseller of the Product.

3.3 You must retain the original purchase receipt and your Limited Warranty, and provide this documentation to Bird to verify your warranty eligibility.

3.4 This Limited Warranty describes the service available to you in the event your Product requires warranty service.

3.5 Your Product must have the serial number clearly legible, unobscured, uneffaced and unmodified.

3.6 Your Product must have its tamper-resistant seals in place and unmodified.


4. Limited Warranty Exclusions

This Limited Warranty describes the service available to you in the event your Product requires warranty service, and you may have additional protections under your local laws. This Limited Warranty does not cover and excludes damage to your Product:

4.1 Caused by abuse, misuse, neglect or commercial use.

4.2 Caused by improper charging, storage, or operation, including, without limitation, use contrary to the owner’s manual and other documentation, use other than in accordance with specified weight and age limits, use on stairs, walls and curbs, or any extreme sport or exhibition use.

4.3 Caused by accident, collision, riding over obstacles, racing, fire, water submersion, high pressure water spray, freezing, earthquake, dropping, severe oxidation, or chemical solvent corrosion.

4.4 Caused by any repair that was unauthorized by Bird.

4.5 Caused from improper packaging or mishandling during shipment to the warranty-service provider.

4.6 That is cosmetic, including, scratches, dents and the removal of protective coatings that are designed to diminish over time, unless such damage occurred due to a defect in materials.

4.7 Caused by the use of the Product with, or any modification to the Product using, any third party product, component or accessory that is not sold by Bird.

4.8 That does not arise from Bird’s product-design, technology, manufacturing or quality.


5. Liability Disclaimer and Limitation

Bird does not assume, nor authorizes anyone to assume on its behalf, any other obligation or liability in connection with a Product, its component parts, accessories, service repair, or this Limited Warranty. Bird is not responsible for any loss of use of a Product, its component parts, accessories, or for any inconvenience or other loss or damage which might be caused from any defect in a Product, its component parts, accessories, service repair, or for any other incidental or consequential damages the purchaser may have as a result of any defect in a Product, its component parts, accessories, or service repair.

THIS LIMITED WARRANTY IS THE ONLY WARRANTY APPLICABLE TO PRODUCT AND ITS COMPONENT PARTS, ACCESSORIES, AND SERVICE REPAIR. BIRD AND ITS AFFILIATED COMPANIES DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER APPLICABLE LAW. ANY SUCH IMPLIED WARRANTIES WHICH MAY BE REQUIRED BY LAW AND ARE NOT DISCLAIMED HEREBY ARE LIMITED, TO THE EXTENT ALLOWED BY LAW,

TO THE APPLICABLE PERIOD OF THIS LIMITED WARRANTY, OR TO THE APPLICABLE TIME PERIOD PROVIDED BY THE APPLICABLE COUNTRY/ STATE LAW, WHICHEVER PERIOD IS SHORTER. SOME COUNTRIES/STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO SOME PURCHASERS.

BIRD’S TOTAL AND AGGREGATE LIABILITY FOR ALL CLAIMS, JOINT AND SEVERALLY, ARISING HEREUNDER AND ANY AND ALL APPLICABLE WARRANTIES AT LAW ARE LIMITED TO THE REPAIR OR REPLACEMENT OF ANY DEFECTIVE PRODUCT, AS DETERMINED IN BIRD’S DISCRETION, AND ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES ARE HEREBY EXCLUDED, UNLESS SUCH LIMITATIONS AND EXCLUSIONS ARE PROHIBITED BY APPLICABLE LAW. SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.


6. Claims and Dispute Resolution

BIRD AND YOU AGREE THAT ALL CLAIMS OR DISPUTES ARISING IN ANY WAY FROM THIS LIMITED WARRANTY OR THE SALE, CONDITION OR PERFORMANCE OF THE PRODUCT, WHETHER BASED IN CONTRACT, TORT, STATUTORY, FRAUD, MISREPRESENTATION OR ANY OTHER LEGAL THEORY, AND ALL CLAIMS THAT ARE SUBJECT OF A PURPORTED CLASS ACTION LITIGATION THAT YOU ARE NOT A MEMBER OF THE CERTIFIED CLASS, SHALL BE RESOLVED THROUGH ARBITRATION AS PROVIDED FOR HEREIN, OR IN SMALL CLAIMS COURT, AND NOT BY A TRIAL BY JURY. YOU WAIVE THE RIGHT TO A TRIAL BY JURY, AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS ARISING FROM OR RELATING TO ANY AND ALL CLAIMS AND DISPUTES WITH BIRD. YOU AGREE THAT YOU MAY ARBITRATE CLAIMS AGAINST BIRD ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, A CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. THIS AGREEMENT EVIDENCES A TRANSACTION IN INTERSTATE COMMERCE, AND THUS THE FEDERAL ARBITRATION ACT GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS PROVISION. THIS PARAGRAPH SHALL SURVIVE THE TERMINATION OF THIS LIMITED WARRANTY. BIRD REQUIRES THAT YOU ARBITRATE YOUR CLAIMS AGAINST BIRD PURSUANT TO THE ARBITRATION DESCRIBED BELOW PRIOR TO YOUR EXERCISE OF YOUR RIGHTS PURSUANT TO TITLE I OF THE MAGNUSON-MOSS WARRANTY ACT. TITLE I OF THE MAGNUSON- MOSS WARRANTY ACT DOES NOT REQUIRE YOU TO PURSUE RIGHTS AND REMEDIES AVAILABLE TO YOU THAT ARE NOT PROVIDED BY TITLE I OF THE MAGNUSON-MOSS WARRANTY ACT.

Any such arbitration shall not be combined or consolidated with a claim or dispute involving any other person’s or entity’s product or claim or dispute, and specifically, without limitation of the foregoing, shall not under any circumstances proceed as part of a class action or class arbitration.

If you intend to seek arbitration, you must first send to Bird, by certified mail, a written notice of dispute at least thirty (30) days in advance of initiating the arbitration. The notice should be addressed to: Attention: Disputes, Bird Rides, Inc., 406 Broadway #369, Santa Monica CA 90401. The notice must include: (i) a description of your claim and the basis of the dispute; and (ii) a description of the relief you are seeking. If Bird and you do not reach an agreement to resolve the claim within thirty (30) days after Bird receives your notice, you or Bird may commence an arbitration proceeding.

The arbitration will take place in Los Angeles, California or a mutually agreed upon location. Arbitration shall be administered by JAMS, or alternatively a mutually agreed upon arbitrator or arbitration service, under the applicable commercial arbitration rules for JAMS or the mutually agreed upon arbitration service, excluding any rules or procedures governing or permitting class actions. The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to resolve

all disputes arising out of or relating to the interpretation, applicability, enforceability or formation of this Limited Warranty, including, but not limited to any claim that all or any part of this Limited Warranty is void or voidable, or whether a claim is subject to arbitration. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity. The arbitrator’s award shall be written, and binding on the parties and may be entered as a judgment in any court of competent jurisdiction. To the extent the filing fee for the arbitration exceeds the cost of filing a lawsuit, Bird will pay the additional cost. The arbitration rules also permit you to recover attorney’s fees in certain cases. The parties understand that, absent this mandatory provision, they would have the right to sue in court and have a jury trial. They further understand that, in some instances, the costs of arbitration could exceed the costs of litigation and the right to discovery may be more limited in arbitration than in court.

This arbitration provision also applies to claims and disputes by you, the purchaser of the Product, and all those in privity with you, including your family members, beneficiaries and assigns, against Bird’s subsidiaries and affiliates, and any person or entity that licensed, supplied, sold or distributed the Product, and each of their officers, employees, representatives, licensors/licensees, agents, beneficiaries, predecessors in interest, successors, and/or assigns. You may opt out of this dispute resolution procedure by providing notice to Bird no later than thirty (30) calendar days after the date of the first consumer purchaser’s purchase of the Product. To opt out you must send notice by mail to Attention: Arbitration Opt Out, Bird Rides, Inc., 406 Broadway #369, Santa Monica CA 90401. The opt out notice must include (a) your name, email address, mailing address and phone number; (b) the date on which the product was purchased; (c) the product model name or model number; and (d) the Serial Number. Opting out of this dispute resolution procedure will not affect the coverage of the Limited Warranty in any way, and you will continue to enjoy the benefits of the Limited Warranty. If you opt-out of these arbitration provisions, Bird also will not be bound by them.
